Terms of Service
Effective date: May 1, 2025
1. Acceptance of Terms
By booking, scheduling, or accepting any service from BAC Pest Control (“BAC”, “we”, “us”), you agree to these Terms of Service. If you are booking on behalf of a business, property management company, or other organization, you confirm you have authority to bind that entity to these terms.
These terms apply to all pest control services provided by BAC Pest Control in Ontario, Canada. We reserve the right to update these terms at any time. Continued use of our services after an update constitutes acceptance of the revised terms.
2. Description of Services
BAC Pest Control provides residential and commercial pest management services including, but not limited to: rodent control, bed bug treatment, cockroach control, ant control, wasp nest removal, and emergency pest response. All services are carried out by licensed technicians in accordance with Ontario pesticide regulations and product label directions.
A written treatment report is provided after every service. The scope of each service — including treatment method, products used, and re-entry timing — is explained to the client before work begins. No service proceeds without client approval of the quoted scope.
BAC holds a Structural Extermination licence and full commercial liability insurance. All work falls within our licensed scope. We will not perform work outside our licence regardless of client request.
3. Pricing and Payment
All pricing is provided after an on-site inspection. No work begins until a written quote has been presented and accepted. Prices are quoted in Canadian dollars. Ontario HST (13%) applies where required by law.
Residential clients: Payment is due on completion of service unless otherwise agreed in writing. Accepted methods: cash, credit card, and cheque.
Commercial clients and property managers: Invoices are issued on net-30 terms unless a different arrangement is confirmed in writing prior to the start of service. Accounts more than 30 days past due are subject to a 1.5% monthly interest charge on the outstanding balance. We reserve the right to suspend service on accounts with overdue balances.
Returned cheques are subject to a $35 processing fee. We reserve the right to require pre-payment for clients with a history of late or failed payment.
4. Cancellation and Rescheduling
We require a minimum of 24 hours' noticeto cancel or reschedule an appointment. Cancellations made with less than 24 hours' notice may be subject to a cancellation fee equal to the lesser of $75 or 25% of the quoted service value. This fee covers the technician's reserved time and any materials prepared for the job.
Emergency same-day appointments that are cancelled after the technician has dispatched are subject to a trip charge not to exceed $60.
BAC reserves the right to reschedule appointments due to technician illness, weather, or other circumstances outside our control. We will provide as much advance notice as possible and will not charge cancellation fees for rescheduling initiated by BAC.
5. Client Obligations
To allow us to perform services effectively and safely, you agree to:
- Provide accurate information about the pest issue, property layout, and any known sensitivities (chemical allergies, pets, medical conditions).
- Follow the preparation checklist provided before treatment, including any required cleaning, food storage, or temporary relocation of occupants or pets.
- Provide clear access to all areas identified in the service agreement, including attic, basement, crawl spaces, and mechanical rooms.
- Observe re-entry times communicated after treatment and relay those instructions to all occupants.
- Notify BAC promptly if conditions change between a quote and the scheduled service date.
Failure to follow preparation instructions may reduce treatment effectiveness and voids any applicable warranty. A re-service fee may apply if a follow-up visit is required due to non-compliance with preparation instructions.
6. Limitation of Liability
BAC Pest Control carries full commercial liability insurance. Our total liability to any client for any claim arising out of or related to a service is limited to the amount paid by the client for that specific service.
We are not liable for:
- Indirect, incidental, or consequential damages, including lost income, lost rental revenue, or the cost of temporary accommodation.
- Pre-existing structural damage or damage attributable to the pest infestation itself.
- Damage to items the client failed to disclose or move prior to treatment.
- Results that fall short of expectations due to the client's failure to follow preparation or post-treatment instructions.
Nothing in these terms limits BAC's liability for death or personal injury caused by our negligence, or any other liability that cannot be excluded under applicable Ontario law.
7. Warranty Disclaimer
Pest control is applied to biological systems. Results vary based on infestation severity, property conditions, occupant behaviour, and factors outside our control. We do not guarantee complete elimination in a single treatment.
A follow-up visit is included in all standard service programs to confirm results. If the infestation persists after the follow-up, we will assess and recommend further treatment at a quoted cost.
For severe infestations — including large-scale bed bug infestations, entrenched rodent colonies, or multi-unit cockroach infestations — complete resolution is not guaranteed in a single treatment cycle. We communicate this before work begins. We do not overstate outcomes.
No warranty applies where treatment failure is attributable to re-infestation from adjacent untreated units, failure to follow preparation instructions, or introduction of new pest sources after treatment.
8. Pesticide Use and Safety
All pesticide applications are performed by licensed personnel in compliance with Ontario's Pesticides Act and applicable regulations. Product information and Safety Data Sheets (SDS) are available upon request.
You are responsible for informing us of any occupant health conditions, allergies, or sensitivities that may affect product selection. We will accommodate reasonable requests for alternative treatments where the pest biology and infestation severity allow.
9. Privacy
BAC Pest Control collects and uses client information solely to book, perform, and follow up on pest control services. We do not sell client data. For full details, see our Privacy Policy.
10. Governing Law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute arising under these terms is subject to the exclusive jurisdiction of the courts of Ontario.
11. Changes to These Terms
We may update these terms at any time. Material changes will be posted on this page with an updated effective date. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
